Clause 1
Introduction & Acceptance
These Terms and Conditions ('Terms') constitute a legally binding agreement between SVS Unitech Private Limited (hereinafter 'the Company', 'We', 'Us', or 'Our'), a company incorporated under the Companies Act, 2013, and registered in India, and its authorised employees, managers, and directors (hereinafter 'User', 'You', or 'Your') who access or use the LIFTIN application ('Application' or 'App').
The Application is an internal employee management system developed exclusively for the operational and administrative use of SVS Unitech Private Limited. Access to the Application is restricted solely to authorised personnel.
By logging into, accessing, or using the Application - whether via the mobile application (iOS or Android) or the web-based admin panel - the User acknowledges that they have read, understood, and agree to be legally bound by these Terms, in accordance with the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.
Electronic acceptance of these Terms through use of the Application constitutes a valid and enforceable contract under Section 10A of the Information Technology Act, 2000.
If the User does not agree to these Terms, they must immediately discontinue use of the Application and notify the Company's designated administrator.
Clause 2
Scope of Application
The LIFTIN application encompasses the following functional modules:
- Attendance Management - Clock-in/clock-out functionality and attendance history.
- GPS-Based Location Tracking - Real-time location tracking during active shifts.
- Leave & Comp-off Management - Leave application and compensatory-off requests.
- Attendance Regularization - Correction and amendment of attendance records.
- Expense Management - Expense claim submission and historical records.
- Payroll & Payslip - Auto-generated monthly payslips based on attendance and base salary.
- Device Management - Company device assignment, issue reporting, and history.
- Announcements - Official company communication and employee reactions.
- Employee Directory (My Team) - Intra-team employee details and contact information.
- Employee Data Visibility - Weekly birthday and leave displays for internal awareness.
- Sales Overview - Display of individual and team sales performance summaries.
- Records & History - Comprehensive audit trail of all employee activities.
The Application is intended exclusively for internal operational purposes and shall not be used for any purpose beyond the scope defined herein.
Clause 3
User Eligibility
Access to the Application is restricted to persons who:
- Are current employees, managers, or the Executive Director of SVS Unitech Private Limited;
- Have been granted authorised login credentials by the Company's system administrator;
- Have acknowledged and accepted these Terms prior to or upon first use of the Application;
- Are of legal age as defined under Indian law to enter into a binding contract.
The Company reserves the right to grant, restrict, suspend, or revoke access to the Application at its sole discretion, without prior notice, if it determines that such action is necessary for operational, disciplinary, or legal reasons.
Upon cessation of employment, whether by resignation, termination, or otherwise, the User's access credentials shall be revoked immediately. Continued unauthorised access thereafter shall constitute a violation of the Information Technology Act, 2000.
Clause 4
User Roles & Access
Executive Director
The Executive Director holds the highest level of access within the Application, accessible exclusively through the Web Admin Panel. This role is authorised to:
- Exercise full administrative control over all Application modules and system configurations;
- Access, review, and modify all employee data including attendance, payroll, and records;
- Post, edit, and manage official announcements including videos and company updates;
- Configure system-wide settings, permissions, and operational parameters;
- Generate, verify, and authorise payroll and payslip data;
- Oversee GPS tracking data and employee activity monitoring;
- Update and verify sales performance data on behalf of the organisation.
Managers
Managers access the Application exclusively through the Mobile Application (iOS/Android). Their access is limited to:
- Their own personal attendance, leave, expense, and payroll information;
- Viewing team-level information within the scope of the 'My Team' directory;
- Viewing team-based leave and birthday displays;
- Submitting attendance regularization requests, leave applications, and expense claims;
- Reporting device issues and viewing assigned device history.
Employees
Employees access the Application exclusively through the Mobile Application (iOS/Android). Access is strictly limited to:
- Personal attendance records, payslips, leave history, and expense submissions;
- 'My Team' directory information limited to members of their respective team;
- Company announcements posted by the Executive Director;
- Sales overview data relevant to their own performance;
- Device management records for their assigned company device.
Any attempt by a User to access data, modules, or functionalities beyond their designated role shall be considered a serious breach of these Terms and may attract legal consequences under applicable Indian law.
Clause 5
Account Security
Each User shall be issued a unique set of login credentials (username and password). The User is solely responsible for maintaining the confidentiality and security of their credentials at all times.
The following obligations are binding on all Users in respect of account security:
- Users must not share their login credentials with any other person under any circumstances;
- Users must select strong passwords and change them periodically or upon suspicion of compromise;
- Users must not allow any other person to access the Application using their credentials;
- Users must log out of the Application upon completion of each session;
- Users must immediately notify the system administrator upon discovery or suspicion of unauthorised access to their account.
Password Recovery: In the event of a forgotten or compromised password, the User may initiate a password reset through the official One-Time Password (OTP) mechanism delivered to their registered company email address. OTPs are valid for a limited duration and must not be shared with any third party.
The Company shall not be liable for any loss, damage, or unauthorised access resulting from the User's failure to maintain the security of their credentials.
The Company reserves the right to suspend or disable any account that it reasonably believes has been compromised, misused, or used in violation of these Terms.
Clause 6
GPS Tracking & Monitoring
The LIFTIN Application incorporates a GPS-based location tracking feature as an integral component of its attendance and workforce management functionality.
The following conditions govern GPS tracking:
- Location data shall be captured at intervals of every fifteen (15) minutes during the User's active work shift, commencing upon clock-in and terminating upon clock-out or logout;
- GPS tracking is strictly limited to working hours and shall not operate outside the User's designated shift period;
- The Application shall automatically cease GPS data capture upon the User logging out or upon the end of the assigned shift;
- Location data is transmitted securely to the Company's private cloud server and is accessible only to authorised personnel.
Consent: By installing and using the LIFTIN application, the User explicitly and freely consents to the collection and processing of their GPS location data strictly during working hours, for the purposes of attendance verification, workforce management, and operational compliance. This consent is given in accordance with the Digital Personal Data Protection Act, 2023.
Prohibited Conduct: The following acts in relation to GPS tracking are strictly prohibited and constitute gross misconduct:
- Attempting to spoof, falsify, manipulate, or alter GPS location data;
- Using any third-party application, software, or hardware to simulate a false location;
- Interfering with or disabling the GPS tracking functionality of the Application;
- Requesting or assisting another person to falsify location data on their behalf.
Clause 7
Data Collection & Usage
Categories of Data Collected
The Application collects and processes the following categories of personal and operational data:
- Personal Identification Data: Full name, employee ID, official email address, phone number (including WhatsApp contact), and profile photograph;
- Attendance Data: Clock-in and clock-out timestamps, attendance status, and regularization records;
- GPS Location Data: Real-time location coordinates captured every 15 minutes during active shifts;
- Leave & Comp-off Data: Leave applications, approvals, rejections, and compensatory-off records;
- Payroll & Financial Data: Base salary, attendance-linked earnings, deductions, and payslip records;
- Expense Data: Expense claims, supporting details, approval status, and claim history;
- Sales Performance Data: Individual and team sales performance summaries as updated by administration;
- Device Management Data: Assigned device details, reported issues, and resolution history;
- System Logs: Login timestamps, session durations, feature interactions, and application activity logs.
Purpose of Data Usage
All data collected through the Application is used exclusively for the following lawful purposes:
- Attendance tracking, payroll computation, and workforce administration;
- Performance monitoring, leave management, and HR operations;
- Ensuring security, preventing fraud, and maintaining system integrity;
- Facilitating internal communication and operational transparency;
- Compliance with applicable statutory, regulatory, and audit requirements;
- Dispute resolution and maintenance of legally required employment records.
Data Storage
All data collected by the Application is stored on a secure, private cloud server maintained by or on behalf of the Company. Access to stored data is strictly restricted to authorised personnel with a legitimate operational need. The Company implements appropriate technical and organisational measures to protect data from unauthorised access, disclosure, alteration, or destruction.
Data Retention
Data shall be retained for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law, including statutory employment and financial record-keeping obligations. Upon cessation of employment, the Company shall handle personal data in accordance with applicable data protection laws.
Third-Party Disclosure
The Company shall not sell, transfer, or disclose employee personal data to any third party, except: (a) where required by law or court order; (b) to authorised service providers operating under binding confidentiality obligations; or (c) with the explicit written consent of the employee.
Clause 8
User Responsibilities
Every User of the LIFTIN Application assumes the following obligations:
- To use the Application solely for its intended official and operational purposes;
- To provide accurate, truthful, and complete information in all submissions and records;
- To clock in and clock out accurately and in real time, reflecting actual working hours;
- To submit leave applications, comp-off requests, and expense claims in good faith with accurate supporting information;
- To promptly report any technical issue, data error, or discrepancy observed within the Application to the designated system administrator;
- To adhere to all Company policies referenced in or associated with the Application;
- To maintain the security of login credentials and log out of sessions upon completion;
- To report payslip discrepancies within the period specified in Clause 11 of these Terms;
- To refrain from any action that may compromise the integrity, security, or performance of the Application or the data it processes.
Users are responsible for ensuring that the device used to access the Application - whether personal or company-issued - is secured against unauthorised access.
Clause 9
Acceptable Use
Permitted Use
The Application may be used exclusively for official, work-related purposes as defined by the Company, including attendance management, leave requests, payroll access, team communication, and other functions described in Clause 2 of these Terms.
Prohibited Activities
The following activities are strictly prohibited:
- Sharing, transferring, or disclosing login credentials to any other person;
- Manipulating, altering, or falsifying attendance records, clock-in/out data, or GPS location;
- Submitting false, exaggerated, or fraudulent expense claims or supporting documents;
- Accessing, copying, or misusing any employee personal data visible within the Application, including contact information from the 'My Team' directory;
- Using the Application for personal, commercial, or non-official purposes;
- Attempting to gain unauthorised access to systems, modules, or data beyond the User's role;
- Installing, deploying, or using any software to interfere with, bypass, or manipulate Application functionality;
- Uploading, transmitting, or distributing any malicious code, unauthorised files, or inappropriate content through the Application;
- Reproducing, distributing, or commercially exploiting any content, data, or intellectual property derived from the Application;
- Using another employee's credentials or impersonating another User within the Application.
The Company reserves the right to monitor Application usage to detect and investigate violations of these acceptable use provisions.
Clause 10
Misconduct & Disciplinary Action
The following acts shall be treated as gross misconduct and may attract the disciplinary consequences specified herein:
GPS Location Fraud
Any attempt to spoof, falsify, or manipulate GPS location data - including the use of third-party applications or hardware to simulate a false location - shall constitute gross misconduct warranting immediate termination of employment without notice or severance, and may attract civil and/or criminal liability under applicable Indian law.
Fraudulent Expense Claims
Submission of false, fabricated, or exaggerated expense claims, or the creation of fictitious supporting documentation, shall constitute fraud and shall result in immediate termination of employment. The Company reserves the right to initiate recovery proceedings and file a complaint under the Indian Penal Code, 1860 (or the Bharatiya Nyaya Sanhita, 2023, as applicable).
Data Breach & Misuse of Information
Any unauthorised access to, disclosure of, or misuse of employee personal data, payroll data, or any other confidential information accessible through the Application shall attract legal action under the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and other applicable laws, in addition to disciplinary proceedings including termination.
Attendance Manipulation
Deliberate falsification of attendance records, including recording clock-in/clock-out on behalf of another employee ('buddy punching') or altering historical records without authorisation, shall result in immediate termination and potential legal action.
Other Misconduct
Any other violation of these Terms, including unauthorised access, credential sharing, or misuse of the Application, may result in one or more of the following:
- Written warning or formal reprimand;
- Suspension from Application access;
- Disciplinary proceedings in accordance with Company HR policy;
- Termination of employment with forfeiture of applicable benefits;
- Civil proceedings for damages or injunctive relief;
- Criminal complaint under applicable provisions of Indian law.
Clause 11
Payroll & Payslip
The LIFTIN Application incorporates an automated payroll and payslip generation module. Payslips are auto-generated on a monthly basis, computed on the basis of:
- The employee's verified attendance records for the relevant month;
- The employee's base salary and applicable salary components;
- Applicable deductions, statutory contributions, and leave without pay, as per Company policy.
All payslips generated through the Application are official Company documents and may be used by the employee for personal financial and legal purposes.
The Company reserves the right to correct any computational or data error in a generated payslip. Corrections shall be reflected in a revised payslip or in the subsequent month's payroll, as appropriate, with communication to the affected employee.
Employees are required to review their payslip upon generation and report any discrepancy, omission, or error to the HR department or system administrator within seven (7) calendar days of the payslip being made available on the Application. Discrepancies reported beyond this period may not be considered for retrospective correction.
Payroll data is confidential and shall not be shared, disclosed, or discussed with any unauthorised person. Any unauthorised disclosure may constitute a breach of these Terms and Company confidentiality policy.
Clause 12
Sales Overview
The Sales Overview module within the Application provides a summary display of individual and team sales performance data. The following terms govern this module:
- The Application does not independently track or record sales transactions or activities; all sales performance data is entered, updated, and verified by the Company's administration or authorised backend personnel;
- Sales data displayed on the Application is for internal reporting and performance visibility purposes only and does not constitute a formal performance appraisal or legally binding assessment;
- The Company reserves the right to update, modify, correct, or remove sales data at any time, without prior notice to the employee;
- Any discrepancy in displayed sales data must be reported to the designated administrator within seven (7) calendar days of observation;
- Sales performance information visible to individual employees is limited to their own data and such team-level summaries as the Company deems appropriate to display.
Clause 13
Device Management
The Device Management module enables the Company to assign, track, and manage company-owned devices issued to employees. The following terms apply:
- Employees are responsible for the safe custody and proper use of any company-owned device assigned to them, as reflected in the Application;
- Employees must promptly report any malfunction, damage, loss, or theft of an assigned device through the Device Management module of the Application;
- The Application maintains a complete history of device assignments, reported issues, and resolution status for audit and accountability purposes;
- Failure to report device issues in a timely manner may result in the employee being held liable for repair or replacement costs, as per Company policy;
- Upon cessation of employment, all company-owned devices must be returned in good condition, and device records shall be updated accordingly by the administrator.
Clause 14
Announcements
The Announcements module serves as the official internal communication channel for SVS Unitech Private Limited. The following terms govern its use:
- All announcements, including text updates and video content, shall be posted exclusively by the Executive Director or their authorised designee;
- Announcements constitute official Company communications and shall be treated as such by all employees;
- Employees and managers may acknowledge or react to announcements using the reaction functionality provided within the Application;
- The reaction feature must not be misused, abused, or employed in a manner inconsistent with professional conduct or Company values;
- Users are prohibited from posting, sharing, or distributing announcement content outside the Application without express Company authorisation;
- The Company reserves the right to remove, edit, or retract any announcement at its discretion without prior notice.
Clause 15
Employee Directory (My Team)
The 'My Team' module provides an internal employee directory displaying the following information for members of the User's team:
- Full name and employee identification number;
- Official company email address;
- Company-registered mobile phone number (WhatsApp contact);
- Profile photograph.
The following terms govern access to and use of the My Team directory:
- Access to the directory is limited to employees within the same team; employees shall not have access to the contact information of members outside their designated team;
- Contact information displayed in the directory is provided exclusively for internal, work-related communication purposes;
- Users are strictly prohibited from using, copying, sharing, or distributing any contact information from the directory for personal, commercial, or any non-official purpose;
- Misuse of employee contact information - including unsolicited communication, harassment, or commercial solicitation - shall constitute a breach of these Terms and may attract disciplinary action and legal liability under applicable law;
- The Company reserves the right to update, restrict, or remove directory information at its discretion.
Clause 16
Employee Data Visibility
The Application displays certain employee data on a limited and controlled basis to facilitate internal team coordination and morale.
Birthday Display
The Application displays weekly birthday information for team members. This feature is intended solely to foster workplace camaraderie and is visible only to members of the relevant team.
Leave Display
The Application displays a weekly overview of team members who are on approved leave. This information is displayed on a team-specific basis to facilitate work planning and is limited to leave status without disclosure of medical or personal reasons.
All employee data displayed under this clause is governed by the following restrictions:
- Visibility is strictly limited to members of the relevant team;
- Data displayed is used solely for internal operational and team management purposes;
- Users must not screenshot, record, share, or misuse data displayed under this feature;
- Any concerns regarding the display of personal information may be raised with the HR department or system administrator.
Clause 17
Records & History
The LIFTIN Application automatically maintains a comprehensive historical record of all User activities and transactions, including:
- Attendance records including clock-in/clock-out history, regularization requests, and corrections;
- Leave and comp-off application history, approvals, and rejections;
- Expense claim submissions, approval status, and reimbursement history;
- Payslip generation records and payroll history;
- Device assignment, issue reporting, and resolution history;
- Sales performance summary data as updated by administration.
All records maintained by the Application shall be treated as official Company records and may be used for:
- Internal audit and compliance reviews;
- Payroll computation and financial reporting;
- Dispute resolution between the Company and the employee;
- Statutory and regulatory record-keeping obligations.
The Company reserves the right to correct, amend, or annotate records where administrative errors are identified, with appropriate documentation of such changes.
Employees may access their own historical records within the Application. Requests for official certified copies of records must be directed to the HR department.
Clause 18
Monitoring & Logging
By using the Application, the User acknowledges and consents to the Company's right to monitor Application usage for the following legitimate purposes:
- Ensuring compliance with these Terms and applicable Company policies;
- Detecting, investigating, and preventing fraud, misconduct, or security breaches;
- Monitoring the accuracy and integrity of attendance, GPS, and expense data;
- Maintaining the security, performance, and reliability of the Application and its systems;
- Generating reports and analytics for workforce management and operational decisions.
The Application captures system logs including login/logout timestamps, feature interactions, and data submission records. These logs are accessible to authorised personnel only and are retained in accordance with the Company's data retention policy.
Monitoring activities conducted under this clause shall be proportionate, necessary, and consistent with applicable data protection requirements under the Digital Personal Data Protection Act, 2023.
Clause 19
Data Protection (DPDP Act, 2023)
The Company is committed to processing personal data in accordance with the Digital Personal Data Protection Act, 2023 ('DPDP Act') and applicable rules thereunder.
Lawful Basis for Processing
Personal data is processed on the basis of: (a) the legitimate interests of the Company as the Data Fiduciary in managing its workforce and operations; (b) the User's consent as provided through use of the Application; and (c) compliance with applicable legal obligations.
Rights of the Data Principal
Subject to applicable law and the provisions of the DPDP Act, employees (as Data Principals) have the right to:
- Access a summary of personal data processed by the Company through the Application;
- Request correction of inaccurate or incomplete personal data;
- Seek erasure of personal data in circumstances permitted under the DPDP Act;
- Nominate a representative for data rights in the event of incapacity or death;
- Raise grievances with the Company's designated Data Protection Officer or Grievance Officer.
Grievance Redressal
Employees may direct data protection grievances to the Company's designated contact at support@svsunitechelevators.com. The Company shall endeavour to resolve grievances within a reasonable timeframe as prescribed under applicable law.
Security of Personal Data
The Company implements appropriate technical and organisational security measures, including access controls, encryption, and audit logging, to safeguard personal data from unauthorised access, disclosure, alteration, or destruction.
Cross-Border Transfer
Personal data processed through the Application shall be stored within India. Any transfer of personal data outside India shall be conducted in strict compliance with the provisions of the DPDP Act and applicable Government notifications.
Clause 20
Intellectual Property
The LIFTIN Application, including all its features, modules, user interface, underlying code, database structures, algorithms, branding, logos, designs, content, and documentation, constitutes the exclusive intellectual property of SVS Unitech Private Limited and is protected under applicable Indian intellectual property laws, including the Copyright Act, 1957, and the Trade Marks Act, 1999.
Access to and use of the Application does not confer upon the User any licence, right, title, or interest in any intellectual property of the Company, except the limited, non-exclusive, non-transferable right to use the Application for its intended official purpose during the period of the User's employment.
Users are strictly prohibited from:
- Copying, reproducing, adapting, or distributing any part of the Application;
- Reverse engineering, decompiling, or disassembling the Application's source code;
- Creating derivative works based on the Application or its content;
- Using Company branding, logos, or trademarks in any unauthorised manner;
- Claiming ownership over any content, data, or output generated by the Application.
Any intellectual property created by an employee using Company resources, systems, or data shall be the exclusive property of SVS Unitech Private Limited, unless otherwise agreed in writing.
Clause 21
Termination of Access
A User's access to the Application shall be terminated upon:
- Resignation, retirement, or cessation of employment for any reason;
- Termination of employment, whether with or without cause;
- A serious breach of these Terms or applicable Company policy;
- A decision by the Company at its sole discretion, with or without prior notice.
Upon termination of access:
- All login credentials shall be immediately deactivated;
- The User must cease all use of the Application and any data derived from it;
- Any company-owned devices must be returned to the Company promptly;
- The User's personal data shall be handled in accordance with applicable data protection law and the Company's data retention policy.
Termination of access shall not affect any rights or obligations of either party that have accrued prior to termination, nor shall it limit the Company's right to pursue any legal remedies available in respect of past breaches.
Clause 22
Limitation of Liability
To the fullest extent permitted by applicable Indian law, the Company shall not be liable to the User or any third party for any:
- Loss of data, business interruption, or system downtime attributable to technical failures, maintenance, or force majeure events;
- Inaccuracies in data submitted by Users or errors arising from incorrect information provided by the User;
- Loss or damage arising from the User's breach of these Terms, including unauthorised access or credential misuse;
- Indirect, incidental, consequential, or punitive damages arising from the use of or inability to use the Application.
The Application is provided on an 'as-is' and 'as-available' basis for internal operational use. The Company does not warrant that the Application will be error-free, uninterrupted, or free from security vulnerabilities at all times.
Nothing in this clause shall limit the Company's liability for death or personal injury caused by its negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable Indian law.
Clause 23
Modifications to Terms
The Company reserves the right to revise, update, or amend these Terms at any time, at its sole discretion.
Notice of material amendments shall be communicated to Users through the Application's Announcements module, Company email, or other appropriate communication channels, with a reasonable notice period prior to the amendments taking effect.
Continued use of the Application following the effective date of any amendment shall constitute the User's acceptance of the revised Terms.
Users who do not accept any amended Terms must discontinue use of the Application and notify the system administrator accordingly.
Clause 24
Governing Law & Jurisdiction
These Terms, and any dispute, claim, or matter arising out of or in connection with these Terms or the use of the Application, shall be governed by and construed in accordance with the laws of the Republic of India.
Subject to Clause 24.3, the courts of Chennai, Tamil Nadu shall have exclusive jurisdiction to hear and determine any dispute arising under or in connection with these Terms.
The parties may, by mutual written agreement, refer any dispute to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Chennai, Tamil Nadu, and proceedings conducted in English.
